1) Overview
These Terms govern your access to and use of Torcano (“Service”). By using the Service you agree to these Terms and our Privacy Policy. If you use Torcano on behalf of a company, you represent you have authority to bind that company.
2) Service description
Torcano provides an AI receptionist that operates via WhatsApp and web interfaces to manage enquiries, quotes, invoices, bookings and related operations. Features may change or be updated.
3) Eligibility & accounts
You must be at least 18 and legally able to enter contracts. You’re responsible for your account credentials and all activity under your account.
4) Your responsibilities
- Obtain and maintain all necessary consents to message your contacts (e.g., WhatsApp opt-in).
- Ensure content you submit is accurate and lawful.
- Comply with applicable laws and platform policies (e.g., WhatsApp Business Policy, anti-spam laws).
- Do not misuse the Service (no reverse engineering, abuse, platform scraping, malware, or attempts to overload/interfere).
5) Third-party services
The Service integrates third-party providers (e.g., WhatsApp via Twilio, Azure/OpenAI, Stripe, WordPress/hosting). Your use of those services may be subject to their terms. We are not responsible for third-party outages or changes.
6) Data & privacy
We process personal data as described in our Privacy Policy. For customer end-user data, we act as a processor under our DPA. You retain ownership of your Customer Data; you grant us a license to process it solely to provide and improve the Service.
7) Messaging & consent
You are solely responsible for obtaining and recording end-user consent where required (e.g., WhatsApp opt-in) and for the content of messages sent via your number. You must comply with rate limits and template policies where applicable.
8) Fees & billing (if applicable)
Plans, usage limits, and pricing are shown at sign-up or in your order form. You authorise us (and our payment processor) to charge you for subscriptions, usage, taxes, and any overages. Fees are non-refundable except where required by law or expressly stated.
9) Availability & support
We aim for high availability but do not guarantee uninterrupted service. Maintenance windows, provider outages, and network issues may occur. Standard support is provided via email: hello@torcano.io.
10) Intellectual property
We own the Service and all related IP (software, logos, brand). You may not copy, modify, or create derivative works except as expressly permitted. You grant us a royalty-free license to use your name/logo solely to identify you as a customer (you can opt out by emailing us).
11) Feedback
If you provide feedback or suggestions, we may use them without obligation or compensation.
12) Prohibited content
You must not use the Service for illegal activities, harassment, harmful or deceptive practices, or to transmit content that violates IP rights, privacy, or platform rules.
13) Warranties & disclaimers
The Service is provided “as is” and “as available”. We disclaim all warranties to the maximum extent permitted by law, including fitness for a particular purpose and non-infringement.
14) Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special or punitive damages, or lost profits, revenues, or data. Our total liability for any claim is limited to the amounts you paid to us in the 12 months before the event giving rise to liability.
15) Indemnity
You agree to defend, indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your breach of these Terms or applicable laws.
16) Term & termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, misuse the Service, or for non-payment. Upon termination, your right to use the Service ends; we may retain data as described in the Privacy Policy and applicable law.
17) Governing law & disputes

Jurisdiction: Courts of France
If you’re a consumer and mandatory local law grants you additional rights, those remain unaffected.
18) Changes to these Terms
We may update these Terms from time to time. Material changes will be posted with an updated date. Continued use constitutes acceptance.
